Venue change approved in felony rape trial

        A felony rape trial involving a Fallon man originally scheduled to take place later this month at the Prairie County Courthouse has been moved to Dawson County. The trial date was pushed back to begin July 23, 2012, allowing the defendant’s counsel time to arrange interviews for the case, according to documents filed.

During a hearing last week District Court Judge Richard Simonton approved the state’s request to change the venue from Prairie County. Counsel for defendant Edwin Allan Shearer agreed to the motion for a change of venue, according to documents filed.
Both defendant and complainant reside in Prairie County. 
The case stems from an alleged August 22, 2011 incident that occurred in Terry. Shearer has been charged with one count of sexual intercourse without consent, carrying a maximum penalty of 100 years and a $50,000 fine.
